• Digital image delivery and licensing

3. Service Booking and Scheduling

3.1 Booking Process

To book our services, you must:

• Provide accurate property information and contact details
• Specify service requirements and preferred timing
• Agree to the quoted price and payment terms
• Ensure proper access to the property

3.2 Scheduling and Rescheduling

We will make reasonable efforts to accommodate your preferred scheduling. Rescheduling requests must be made at least 24 hours in advance. Same-day cancellations may incur a fee equal to 50% of the service cost.

3.3 Property Preparation

You are responsible for preparing the property for photography according to our provided guidelines, including but not limited to lighting, decluttering, and staging.

4. Pricing and Payment

4.1 Service Fees

Service fees are as quoted and agreed upon prior to booking. Prices may vary based on:

• Property size and complexity
• Number of images required
• Additional services requested
• Travel distance and accessibility
• Rush delivery requirements

4.2 Payment Terms

Payment is due within 30 days of invoice date unless otherwise agreed. We accept various payment methods including bank transfer, credit cards, and electronic payments. Late payment may result in a 1.5% monthly service charge.

4.3 Additional Costs

Additional costs may apply for:

• Travel beyond our standard service area
• Parking fees or congestion charges
• Additional editing requests beyond standard processing
• Rush delivery services

5. Intellectual Property and Image Rights

5.1 Copyright Ownership

Glowara Spark retains copyright ownership of all photographs and images created during our services. We grant you a non-exclusive, non-transferable license to use the images for real estate marketing purposes.

5.2 Usage Rights

You may use the images for:

• Property marketing and advertising
• MLS listings and real estate websites
• Print marketing materials
• Social media promotion of the specific property

5.3 Usage Restrictions

You may not:

• Resell or license the images to third parties
• Use images for purposes other than marketing the photographed property
• Modify images without our written consent
• Remove watermarks or copyright notices
• Use images after the property is sold (unless specifically licensed)

5.4 Portfolio Usage

We reserve the right to use images from your property shoot for our own marketing, portfolio, and promotional purposes, unless you specifically opt out in writing.

6. Service Delivery and Quality Standards

6.1 Delivery Timeline

Standard delivery is within 24-48 hours of the photography session. Rush delivery may be available for an additional fee. Delivery times may be extended due to:

• High volume periods
• Technical difficulties
• Weather-related delays
• Force majeure events

6.2 Quality Standards

All images will be professionally edited and color-corrected. We guarantee technical quality standards including proper exposure, sharpness, and color accuracy. Artistic preferences are subjective and not grounds for refund.

6.3 Retakes and Revisions

We will provide reasonable retakes or revisions if images fail to meet our technical quality standards. Additional shoots due to client preference changes or inadequate property preparation may incur additional charges.

7. Cancellation and Refund Policy

7.1 Client Cancellation

• More than 48 hours: Full refund of any deposits paid
• 24-48 hours: 50% cancellation fee
• Less than 24 hours: Full service fee charged
• No-show: Full service fee charged

7.2 Company Cancellation

We may cancel services due to unsafe conditions, property inaccessibility, or force majeure events. In such cases, we will reschedule at no additional cost or provide a full refund.

7.3 Refund Processing

Approved refunds will be processed within 10 business days to the original payment method.

8. Limitation of Liability

To the maximum extent permitted by law, Glowara Spark's liability is limited to the amount paid for services. We shall not be liable for:

• Indirect, consequential, or punitive damages
• Lost profits or business opportunities
• Damages resulting from property sale delays or failures
• Technical issues beyond our reasonable control
• Damages exceeding the value of services provided

9. Indemnification

You agree to indemnify and hold harmless Glowara Spark from any claims, damages, or expenses arising from:

• Your use of our services or images
• Breach of these Terms
• Property access issues or safety hazards
• Misrepresentation of property ownership or authority
• Violation of third-party rights

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Force Majeure

We shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters or severe weather
• Government regulations or restrictions
• Labor disputes or strikes
• Equipment failures or technical issues
• Public health emergencies

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services shall be resolved through:
